pursuant to art. 13 of Legislative Decree 196\/2003, Code regarding the protection of personal data (hereinafter also referred to as the “Privacy Code”), and in accordance with Articles 13 and 14 of the EU Reg. No. 679\/2016 (“GDPR”), TGBC & Associates S.r.l, as “owner” pursuant to the Privacy Code (“ TGBC & Associates <\/strong>” or the “ Owner <\/strong>“) provides you with the following information (the “ Disclosure <\/strong>“) regarding the processing of your personal data, provided or acquired for the purpose of registering on the site or the services provided by TGBC & Associates through mobile application as well as in the activation and provision of services (the “ Services <\/strong>“) that are provided to you by TGBC & Associates following your registration on the Site and your acceptance of the terms and conditions of use, as defined in the documents separately made available to you (the “ Terms <\/strong>“).<\/p>\n

1) Data and information<\/h4>\n

As “personal data”, pursuant to the Privacy Code and this Information, we mean any information relating to a natural person, identified or identifiable, even indirectly, by reference to any other information, including a personal identification number.<\/p>\n

As part of the registration procedure on the Site or any service provided by TGBC & Associates, you will be asked for some personal data (such as name and surname, date of birth, gender, address, e-mail address and telephone numbers) or you will be asked to allow TGBC & Associates to access the data you provide to social networking sites (such as Facebook).<\/p>\n

Always in the registration phase of any services provided by TGBC & Associates, you will be asked for authorization to access your telephone contacts to speed up and simplify the sharing of contacts and the use of the social network. The data processed will therefore also include the telephone numbers in your address book, but the names associated with the numbers will not be acquired and therefore the connection between name and number will take place exclusively in the user’s terminal and not in the TGBC & Associates.<\/p>\n

If you use the Site or other services provided by TGBC & Associates as a “Retailer” (as defined under the Terms) or representative of a “Retailer”, you will also be asked for some data regarding the company that uses or intends to use the Services as a “Retailer” (such as company name or company name , registered office, address, VAT number, e-mail address, website, telephone and fax numbers) as well as some data regarding the “Place” (as defined under the Terms) in relation to which the aforementioned “Retailer” uses or intends to use the Services (such as business name, sign, address, e-mail address, website, telephone and fax numbers).<\/p>\n

Following registration on the Site and \/ or using the Services, TGBC & Associates may receive personal data relating to traffic (such as the Internet IP address), as better specified in point 6 below. Furthermore, for the execution of some Services, TGBC & Associates may request access to data relating to your geographical location, as better specified in point 4 below.<\/p>\n

In the appropriate sections of the Site or other TGBC & Associates, you will be allowed to read this Information and any updated versions of it and \/ or other documents concerning the processing of personal data by TGBC & Associates (the Information, the updated versions of the Information and any other documents concerning the processing of personal data by TGBC & Associates, together with the “ Privacy Documents <\/strong>“). After your registration on the Site or for any other service provided by TGBC & Associates, TGBC & Associates may make changes or updates to the Privacy Documents and this circumstance will be promptly communicated to you via an e-mail message or accessible through the Site and \/ or App. <\/p>\n

The data and information you provide, or otherwise acquired as part of the registration on the Site, will be treated in compliance with the updated Privacy Code pursuant to EU Reg. n. 679\/2016.<\/p>\n

2) Purposes and methods of processing personal data: General Purposes<\/h4>\n

The processing we intend to carry out has the purpose of allowing the provision of the Services requested by the user, including (by way of example but not limited to) the creation and updating of a user profile, the subsequent and autonomous management of the control panel to which the user will have access, collection, storage and processing of data for the purpose of establishing and subsequent operational, technical and administrative management of the relationship connected to the provision of the Services and the carrying out of communications relating to the performance of the relationship established.<\/p>\n

Third party data (telephone numbers, e-mails, social network accounts) present in the address book of your phone or in the social network account and to which TGBC & Associates will have had access with your consent will be used exclusively to allow you to identify other users or for the various activities provided by TGBC & Associates, to the extent that the latter have agreed to be identified in these ways.<\/p>\n

The data will also be processed to fulfill legal obligations and regulations or arising from EU legislation, for the implementation of directives or requests from public authorities as well as for the performance of activities aimed at the prevention and repression of computer fraud. The data will also be processed to execute your specific requests before the conclusion of a contract with TGBC & Associates or to provide you with additional services you subsequently requested. Personal data may also be processed for the purpose of allowing navigation and consultation of the websites of TGBC & Associates. Furthermore, the purposes of the processing also concern the collection, storage and processing of your data to perform statistical analysis in anonymous and \/ or aggregate form, without the possibility of identifying the user, aimed at verifying the quality of the services offered.<\/p>\n

3) Purposes and methods of processing personal data: Other purposes<\/h4>\n

With your consent, the data may be processed for the following purposes: for marketing and advertising promotion in a broad sense; to provide information and \/ or make offers on products, services or initiatives offered or promoted by TGBC & Associates, from affiliated and \/ or controlled companies, as well as from commercial partners and outsourcers, without this resulting in the transfer of personal data to third parties; for the elaboration of studies and statistical and market research also through third parties; for communication and sending, also with automated methods, of advertising material, information and commercial information by e-mail and paper, including from third parties; to measure the degree of customer satisfaction with the quality of services, also through telephone interviews; for the promotion of value-added electronic communications services.<\/p>\n

3.1) Automated decision-making process, including profiling activity. <\/h5>\n

Pursuant to the provisions of the legislation introduced with the GDPR, your consent is required so that your data can be used for profiling activities, or for any automated decision-making process, which allows to evaluate certain personal aspects, as well as to analyze aspects relating to the professional occupancy, economic situation, health, personal preferences, interests, reliability, behavior, location or travel of said natural person. These activities could be useful in order to improve our products and services, thus having the opportunity to propose offers in line with your preferences.<\/p>\n

4) Geolocation <\/h4>\n

Some Services are enabled for the user’s geolocation. If the user uses these Services, TGBC & Associates may receive data indicating the geographic location of the user’s terminal equipment. In case of access to one of these services, you will be asked for consent for the acquisition of such data relating to the user’s location. Consent will also be considered given in relation to any subsequent use of any Service enabled for the user’s geolocation. The user’s geolocation consent can be revoked at any time in the appropriate section of the Site, including the App.<\/p>\n

5) Compulsory or optional nature of providing data. Consequences of lack of consent. <\/h4>\n

The provision of data for the purposes referred to in point 2 above is mandatory and their failure, partial or incorrect provision may result in the inability to provide the Services.<\/p>\n

The provision of data for the purposes referred to in points 3 and 3.1 above is optional and their processing requires your express consent at the time of activation of the requested Services or even after such activation. The consent given will remain valid until the next possible revocation by the user. The withdrawal of consent can be done at any time in the appropriate section of the Site, also through the App or by e-mail communication to segreteria@tgbc.it<\/strong><\/a>.<\/p>\n

The provision of data for the purposes referred to in point 4 is optional and their processing requires your express consent at the time of activation of the requested Services or even after such activation. However, as regulated in point 4 above, failure to provide consent to the use of data relating to the user’s geolocation could prevent the provision of some Services or the execution of some of your specific requests.<\/p>\n

6) Traffic and navigation data<\/h4>\n

The computer systems and software procedures used both for the operation of the Site and for other services provided by TGBC & Associates acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. These are data and information that are not collected to be associated with identified interested parties, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes the IP addresses or domain names of the computers used by users who connect to the site, the addresses in the Uniform Resource Identifier (URI) notation of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the operating system and the user’s IT environment.<\/p>\n

The data are used for the sole purpose of obtaining anonymous statistical information on the use of the Site or for other services provided by TGBC & Associates and to check their correct functioning. The data is deleted immediately after processing. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the Site or third parties: except for this possibility, the data in question are not stored permanently, unless requested by the user ( eg: access to the user’s personal pages within the Site that summarize the services used, the information published, etc. ).<\/p>\n

With reference to the use of cookies or systems for tracing \/ permanent monitoring of users, we inform you that access to the site may involve the sending – by the servers to the user’s terminal – of files text to obtain information on its navigation within the site. Pursuant to Article 122 of the Privacy Code, we inform you that the sending of non-persistent cookies is necessary to allow the provision of some Services that require the identification of the user’s path through different pages of the Site. For any access to the Site, regardless of the presence of a cookie, the following information is recorded: browser type, operating system, host and URL of origin of the visitor, in addition to the data on the requested page. This data can be used in aggregate and anonymous form for statistical analysis on the use of the site. Finally, the use of so-called session cookies (which are not stored permanently on the user’s computer and disappear when the browser is closed) is strictly limited to the transmission of session identifiers (consisting of random numbers generated by the server) necessary to allow safe exploration and efficient site. It is always possible to deactivate, in a simple and easy way, the operation of cookies on your part, by operating through the configuration options of the browser you use. <\/p>\n

7) Data made available by the user <\/h4>\n

As part of the use of the services, you may provide, disseminate and \/ or share with other users of the content, images, text messages, data and \/ or information of other types, which could be accessible and usable by other users. Such content may also include personal data. We remind you that such data could be accessible, usable, reproducible by other users of the Website of the social channels or other services provided, who could copy and disseminate them. TGBC & Associates cannot control the data and content entered or shared by you or by other users through the various services provided by TGBC & Associates and cannot, therefore, guarantee the confidentiality of such data and contents, nor can it control their circulation.<\/p>\n

You undertake, pursuant to the Terms, not to enter, provide, disseminate and \/ or share in any way “sensitive data” pursuant to the Privacy Code (ie data suitable for revealing racial and ethnic origin, religious, philosophical or other beliefs, political opinions, membership of parties, trade unions, associations or organizations of a religious, philosophical, political or trade union nature, or data suitable for revealing the state of health and sexual life). You also undertake not to provide confidential data or information whose use by unwanted third parties could harm you.<\/p>\n

We invite you to check and modify the privacy settings of your profile as appropriate for you and in any case we invite you not to publish or provide data, content or information that you prefer to keep confidential.<\/p>\n

We remind you that, in the context of using the Site, the App and \/ or the Services, you process personal data, even sensitive, of third parties, you will be considered as an independent “owner” of this treatment, assuming all legal obligations and responsibilities.<\/p>\n

We remind you that, pursuant to the Terms, you acknowledge that any data or information you make available, disseminated or shared through the use of the Site, the App and \/ or the Services or through the use of any web or telematic space, messaging and \/ or electronic communication service made available to you by TGBC & Associates, is voluntarily provided by you under your responsibility, that TGBC & Associates will not be responsible for the dissemination or communication of such data and content and that you will keep TGBC & Associates as well as its affiliates, employees or consultants entirely indemnified from any damage, loss, third party claims, penalty or cost that may arise following the disclosure of such data or information by you.<\/p>\n

8) Data processing and storage methods <\/h4>\n

The processing of your personal data takes place using manual and \/ or IT and telematic tools in compliance with the organizational, physical and logical measures provided for by the provisions in force. Personal data will be stored, in relation to the intended purposes, for the time provided for by the relevant legislation.<\/p>\n

The data will be stored on TGBC & Associates S.r.l located in dedicated spaces at Aruba or alternative site manager service. In any case, and unless the law states otherwise, the retention period of your data will be exclusively represented by the time necessary to pursue the aforementioned purposes and will be equal to the duration of the service relationship between you and the Data Controller. Should you cancel your account, by ceasing to use the Services, your data will be deleted, except for the need for contractual, administrative, tax, accounting or legal obligations following the termination of your use of the service. As soon as the aforementioned obligations are fulfilled, your data will, in any case, be deleted.<\/p>\n

We also inform you that the data will be collected, processed and stored in full compliance with the provisions of articles 31 and following of the Privacy Code and the Technical Regulations – Annex B to the Privacy Code – regarding security measures.<\/p>\n

9) Dissemination of data<\/h4>\n

Your common personal data may be disclosed to: people, companies or professional firms that provide assistance and advice to TGBC & Associates in accounting, administrative, legal, tax and financial matters relating to the provision of the Services; subjects, bodies or authorities to whom the communication of your personal data must be carried out in accordance with the provisions of the law or orders of the authorities; subjects delegated and \/ or appointed by TGBC & Associates with carrying out activities strictly related to the provision of the Services or with which it is necessary to interact for the provision of the Services (for example the national and foreign registration authorities to whom the technical and administrative documentation and the Maintainer forms are transmitted, the authorities that manage the WHOIS database which contains the personal data of the assignees of domain names, etc.); subjects delegated and \/ or appointed by TGBC & Associates to carry out technical maintenance activities (including maintenance of network equipment and electronic communication networks); commercial partners in the event that you have given specific consent to this type of treatment.<\/p>\n

Furthermore, the subjects or categories of subjects to whom they may be communicated, or who may become aware of your personal data as “managers” of the treatment (if appointed) or “persons in charge” are: partners of TGBC & Associates, i.e. Italian or foreign companies that collaborate in the technical and IT aspects, TGBC & Associates in charge of the administrative and \/ or technical management of the Services, responsible for the IT platform through which the Services are provided. <\/p>\n

With reference to the scope of dissemination of your personal data, the personal data necessary to activate the Services will not be disseminated, unless this is done voluntarily by you through the use of the spaces and services made available by TGBC & Associates.<\/p>\n

9.1) Dissemination of data abroad<\/h5>\n

If your data should be disclosed in countries not included among those belonging to the European Union, or to International Organizations, for which the European Commission has recognized an adequate level of data protection, the same will be treated in compliance of the existing rules envisaged at Community level.<\/p>\n

If, on the other hand, your data should be processed in countries outside the European Union, or International Organizations, whose level of protection has not been recognized by the European Commission, we will rely on any exceptions applicable to the specific situation or to standard contractual clauses approved by the European Commission.<\/p>\n

10) Right of access and other rights<\/h4>\n

You have the right to exercise the provisions of Article 7 of the Privacy Code, reproduced in its entirety below.<\/p>\n
